The two men accused of killing 26-year-old David Rowser, at the One Guy from Italy restaurant, were each indicted on one count of murder.

Sesilio Lopez, 28, and Brian Suniga, 32, remain jailed on a $1 million bond. Rowser, a One Guy employee, was fatally shot in December when he confronted two suspects who had demanded money from the cashier at the 50th Street and Quaker Avenue restaurant.

The suspects didn't get money from the register, but they fled the restaurant with a tip jar.

Lopez and Suniga were later arrested near Abilene. At this time the indictments are for murder, but the charges could be upgraded to capital murder which would put the death penalty in play.
